BEING A RESOLUTION DECLARING IT NECESSARY TO LEVY A TAX IN EXCESS OF THE TEN MILL LIMITATION, FOR 5/10THS MILL (RENEWAL) FOR RECREATIONAL PURPOSES.
The Council of the City of Salem, Columbiana, County, Ohio, met in Regular Session on the 7th day of December, at the City Hall, Salem, Ohio.
Mrs. Apicella moved the adoption of the following Resolution:
WHEREAS, the amount of taxes which may be raised within the ten mill limitation by levies on the current tax duplicate will be insufficient to provide an adequate amount for the necessary requirements of said City of Salem, Columbiana County, Ohio; therefore
BE IT RESOLVED by the Council of the City of Salem, Columbiana County, Ohio, two-thirds of all members elected thereto concurring, that it is necessary to levy a tax in excess of the ten mill limitation for the benefit of the City of Salem for the purpose of providing an adequate amount for recreational purposes of the subdivision under Ohio Revised Code, Section 5705.19 (H) at a rate not exceeding 5/10ths of a mill for each one dollar of valuation, which amounts to five (5)cents for each one hundred dollars of valuation, for five years beginning with tax year 2000 and continuing through 2001, 2002, 2003 and 2004, and which levy is a renewal of an existing levy of 5/10ths mill approved by the voters on May 2, 1995; therefore be it
RESOLVED, that the question of levying taxes which is a renewal of an existing levy, and does include a levy upon the duplicate of the current year, shall be submitted to the electors of said City of Salem at the General Election to be held at the usual voting places within said City of Salem on the 7th day of March, 2000; and be it further
RESOLVED, that said levy be extended on the tax list of the City of Salem, if electors voting thereon vote in favor thereof; and be it further
RESOLVED, that pursuant to Ohio Revised Code Section 5705.25 the form of the ballots cast be as follows:
A RENEWAL of a tax of 5/10ths mill, for the benefit of CITY OF SALEM, Columbiana County, Ohio, for the purpose of providing an adequate amount FOR RECREATIONAL PURPOSES within said City at a rate not exceeding FIVE-TENTHS (.5) of ONE (1) MILL for each one dollar of valuation, which amounts to FIVE CENTS ($0.05) for each one hundred dollars of valuation, for EACH OF THE TAX YEARS, 2000, 2001,2002,2003 and 2004.
RESOLVED, that the Clerk of this Council be, and is hereby directed to certify a copy of this Resolution on or before December 23, 1999, to the Board of Elections, Columbiana County, Ohio as provided by law, and notify said Board of Elections to cause notice of election on the question of levying said tax to be given as required by law; and be it further
RESOLVED, that pursuant to Ohio Revised Code Section 5705.19, this Resolution shall go into effect immediately upon its passage, and no publication is necessary other than that provided for in the Notice of Election.
