BEING AN ORDINANCE ACCEPTING THE GIBBS, ET AL., APPLICATION FOR ANNEXATION OF CERTAIN TERRITORY CONTAINING 148.220 ACRES IN PERRY TOWNSHIP TO THE CITY OF SALEM.
WHEREAS, a petition for the annexation of 148.220 acres in Perry Township to the City of Salem was duly filed by Gibbs, et al.; and
WHEREAS, the petition was duly considered by the Board of County Commissioners of Columbiana County, Ohio, on October 29, 1997; and
WHEREAS, the Board of County Commissioners, pursuant to order of the Court of Common Pleas, entered an order on its journal on September 22, 1999, granting the petition for annexation; and
WHEREAS, the Board of County Commissioners pursuant to O.R.C. §709.033, certified the transcript of its proceedings, the petition, map and other papers required in connection therewith to the Clerk of this Council, who received the same on September 27, 1999; and
WHEREAS, sixty (60) days from the date of the filing have now elapsed and the Clerk of Council has laid the same before Council in accordance with the provisions of O.R.C. §709.04.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, STATE OF OHIO:
SECTION 1:
That the Gibbs, et al., application for annexation of 148.220 acres described in Exhibit A attached hereto and incorporated herein by reference in Perry Township to the City of Salem is hereby accepted.
SECTION 2:
That pursuant to O.R.C. §709.06 the Clerk be, and hereby is, authorized and directed to make three (3) copies of this ordinance to each of which shall be attached a copy of the petition, the map or plat accompanying the petition, a transcript of proceedings of the Board of County Commissioners relating thereto, all resolutions or ordinances in relation to the annexation and a certificate as to the correctness thereof, and then forthwith deliver one (1) copy to the County Auditor, one (1) copy to the County Recorder, and one (1) copy to the Secretary of State and file notice of this annexation with the Board of Elections within thirty (30) days after it becomes effective, and the Clerk shall do all other things required by law.
SECTION 3:
This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this resolution were adopted in an open meeting of this Council and that all deliberations of this Council and of any of its committees that resulted in those formal actions were in meetings open to the public in compliance with the law.
