BEING AN ORDINANCE AUTHORIZING THE SALE OF AN OBSOLETE, UNFIT, OR UNNEEDED VEHICLE TO BE MADE SIMULTANEOUSLY WITH THE PURCHASE OF A NEW VEHICLE OF THE SAME TYPE AND AUTHORIZING THE SUPERINTENDENT OF UTILITIES TO APPROPRIATELY ADVERTISE AND CONSUMMATE SUCH SALE AND PURCHASE BY A SINGLE CONTRACT, AND DECLARING AN EMERGENCY.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, STATE OF OHIO:
SECTION 1:
That pursuant to Ohio Revised Code §721.15, Council finds that the City has one (1) 1986 model year four-wheel drive pick-up truck and snow blade which is no longer needed or is unfit for public use and further finds that the City has need of one (1) new 2000 model year four-wheel drive pick-up truck and snow blade meeting specifications of the Salem Utilities Department and further finds that it will be in the best interest of the City that such sale of the City owned vehicle be made simultaneously with the purchase of the new vehicle.
SECTION 2:
That the Superintendent of Utilities is authorized to offer to sell the City vehicle and to have the selling price for the same credited against the purchase price of the new vehicle and to consummate such sale and purchase by a single contract with the lowest and best bidder to be determined by subtracting from the selling price of the new vehicle to be purchased the purchase price offered for the City vehicle; and furthermore, that the Superintendent of Utilities shall first advertise the sale and purchase of said vehicles as required by Ohio Revised Code §721.15.
SECTION 3:
That the cost of the new 2000 model year four-wheel drive pick-up truck and snow blade shall be paid one-half from Water Revenue Funds and one-half from Wastewater Revenue Funds.
SECTION 4:
That Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council and that all deliberations of this Council and of its committees that resulted in those formal actions were in meetings open to the public in compliance with the law.
SECTION 5:
That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, and safety in the City of Salem, and shall go into immediate effect for the reason that it is necessary to keep the Salem Utilities Department's equipment inventory in sound and uninterrupted operation.
