BEING AN ORDINANCE TO PETITION THE BOARD OF COUNTY COMMISSIONERS, PURSUANT TO OHIO REVISED CODE 503.07, TO ERECT A NEW TOWNSHIP OUT OF THE PORTION OF PERRY TOWNSHIP LOCATED WITHIN THE CITY LIMITS OF THE MUNICIPAL CORPORATION OF THE CITY OF SALEM, AND DECLARING AN EMERGENCY.

WHEREAS, Ohio Revised Code Section 503.07 allows the legislative authority of a municipal corporation that does not comprise the whole of the township in which it is located, to petition the board of county commissioners for a change of township lines to erect a new township out of the portion of such township included within the limits of such municipal corporation; and

WHEREAS, the City of Salem does not comprise the whole of Perry Township, the township in which it is located; and

WHEREAS, upon formation of a new township with limits identical with those of the City of Salem, all offices of the new township shall be abolished and the duties performed by the corresponding officers of the City of Salem, pursuant to Ohio Revised Code Section 703.22; and

WHEREAS, the City of Salem desires to lessen the tax burden on its residents attributable to taxes that support the Township of Perry, without benefit to city residents.

NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, STATE OF OHIO:

SECTION 1:

That the legislative authority of the City of Salem hereby petitions the board of county commissioners of Columbiana County for a change of township lines to erect a new township out of the portion of Perry Township included within the limits of the City of Salem.

SECTION 2:

Upon passage of this ordinance, the law director is directed to present such a petition and an authenticated copy of this ordinance to the board of County Commissioners of Columbiana County.

SECTION 3:

This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this ordinance or resolution were adopted in an open meeting of this Council and that all deliberations of this Council and of any of its committees that resulted in those formal actions were in meetings open to the public in compliance with the law.

SECTION 4:

That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety in the City of Salem and the inhabitants thereof by reason of the immediate need to consolidate the governing bodies of the territorial limits within the City of Salem.
