BEING AN ORDINANCE ZONING THE RECENTLY ANNEXED LANDS TO THE CITY OF SALEM KNOWN AS THE BRICKER FARM ANNEXATION AS "RA MULTIPLE FAMILY RESIDENTIAL" AND "RS-3 SINGLE FAMILY RESIDENTIAL" AND DECLARING AN EMERGENCY.
WHEREAS, the City of Salem recently annexed certain lands from Perry Township and desires to establish its own zoning regulations for said newly annexed lands.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, STATE OF OHIO:
SECTION 1:
That the property described in the legal description and map attached hereto as Exhibit A, shall be and hereby are zoned and designated as RA Multiple Family Residential and RS-3 Single Family Residential as set forth in said Exhibit A.
SECTION 2:
That after introduction of this ordinance to Council, same shall be transmitted by the Clerk of Council to the City Planning Commission for their approval, disapproval or suggestion.
SECTION 3:
That after receiving the Planning Commission's report, or if no report is received after sixty (60) days of Council's transmittal, the Clerk of Council be, and is hereby directed to advertise on two separate occasions in a newspaper of general circulation throughout the municipal corporation, for a public hearing, said hearing to be held thirty (30) days after the last publication.
SECTION 4:
That the Clerk of Council be, and is hereby directed to transfer a copy of this ordinance upon passage to the Zoning Officer and the Zoning Officer shall amend the zoning map accordingly.
SECTION 5:
This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this resolution were adopted in an open meeting of this Council and that all deliberations of this Council and of any of its committees that resulted in those formal actions were in meetings open to the public in compliance with the law.
SECTION 6:
That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety in the City of Salem, and shall go into immediate effect for the reason that it is immediately necessary to establish a city regulated zone for development of this area.
