BEING AN ORDINANCE INDICATING WHAT SERVICES THE CITY OF SALEM WILL PROVIDE TO THE 82.84 ACRES IN SALEM TOWNSHIP, COLUMBIANA COUNTY PROPOSED FOR ANNEXATION BY PETITION FILED WITH THE BOARD OF COUNTY COMMISSIONERS OF COLUMBIANA COUNTY ON OCTOBER 12, 1999, AND DECLARING AN EMERGENCY.

WHEREAS, a petition for annexation of territory to the City of Salem was filed with the Board of County Commissioners of Columbiana County on October 12, 1999, by certain property owners in the 82.24 acres of Salem Township, Columbiana County, Ohio described in that petition and proposed to be annexed, and a hearing on the petition has been set by the Board of Columbiana County Commissioners for December 15, 1999 at 11:00 a. m.; and

WHEREAS, Section 709.031(B) of the Ohio Revised Code requires an Ordinance or Resolution be adopted by the City of Salem indicating what services the City will provide to territory proposed for annexation.

NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, STATE OF OHIO:

SECTION 1:

That the City of Salem will provide the following services to the 82.84 acres in Salem Township, Columbiana County described in the attached legal description and map and proposed for annexation by petition filed with the Columbiana County Board of County Commissioners on October 12, 1999, upon annexation: adequate police and fire protection; water and sewer service pursuant to existing rules and regulations governing such services; and street maintenance, repair, and snow removal upon dedication and acceptance of street located within said territory or which may be constructed within said territory.

SECTION 2:

This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this ordinance or resolution were adopted in an open meeting of this Council and that all deliberations of this Council and of any of its committees that resulted in those formal actions were in meetings open to the public in compliance with the law.

SECTION 3:

That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety in the City of Salem and the inhabitants thereof by reason of the immediate need to adopt an ordinance stating the services to be provided to comply with Section 709.031(B) of the Ohio Revised Code, and shall go into immediate effect.
