BEING A RESOLUTION AUTHORIZING CITY OFFICIALS TO APPLY FOR AND ACCEPT FINANCIAL ASSISTANCE FROM OHIO PUBLIC WORKS COMMISSION ISSUE II FUNDS AND GIVING THOSE OFFICIALS AUTHORITY TO SIGN AND EXECUTE CONTRACTS FOR THE SOUTHEAST BOULEVARD RECONSTRUCTION PROJECT, AND DECLARING AN EMERGENCY.
WHEREAS, Council deems it necessary to reconstruct a portion of Southeast Boulevard for the benefit of the City of Salem, and the total cost has been estimated to be Five Hundred Thirty-Six Thousand Five Hundred and No/100 Dollars ($536,500.00); and
WHEREAS, Council has followed the recommendation of the Director of Public Service that the Project should be actively pursued through Issue II Funding through the Ohio Public Works Commission; and
WHEREAS, Council finds it necessary to designate the chief executive officer, chief financial officer, project manager and contact person to apply for and accept financial assistance for Issue II Grant Funding.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, STATE OF OHIO:
SECTION 1:
That Council hereby designates the following named elected and appointed public officials to apply for Issue II Grant Funding through the Ohio Public Works Commission:
(a) Chief Executive Officer - Larry D. DeJane, Mayor
(b) Chief Financial Officer - James Armeni, Auditor
SECTION 2:
That the above designated elected and appointed public officials are hereby authorized and instructed to submit the appropriate application to the Ohio Public Works Commission through District No. 14 Integrating Committee, 0 Percent Interest Loan Funds for the Southeast Boulevard Reconstruction Project in an amount not to exceed Two Hundred Sixty-Eight Thousand Two Hundred Fifty and No/100 Dollars ($268,250.00).
SECTION 3:
That local share funds for the completion of the Project will be secured from an appropriate fund or any other available grant or loan sources.
SECTION 4:
That the above designated elected and appointed public officials shall execute and deliver all appropriate documents, submittals, acceptances and any and all other contractual documents necessary to carry out the intent of Council to secure the appropriate funding for the Project.
SECTION 5:
That it is found and determined that all formal actions of this Council relating to the passage of this Resolution were adopted in an open meeting of this Council; and that all deliberations of this Council and of any of its Committees; and of the Planning Commission, if necessary, which resulted in such formal actions were made in compliance with all legal requirements of the Ohio Revised Code.
SECTION 6:
That this Resolution is hereby determined to be an emergency measure necessary for the immediate preservation of the public health, safety, and welfare of the citizens of the City of Salem, and shall go into immediate effect for the further reason that Issue II Project Loan Fund is available through the Ohio Public Works Commission provided that the City completes the mandatory application and legislation necessary before the date of funding ends; and in order for the City of Salem to continue to qualify for the Loan Funding, it is necessary that the application and legislation be filed with the Ohio Public Works Commission District No. 14 Integrating Committee immediately in order for the City to remain eligible for the Loan Funding.

Any notice authorized to be given under this Resolution shall refer to this Resolution by number and codification, when available.
