BEING A RESOLUTION AUTHORIZING THE SERVICE DIRECTOR OF THE CITY OF SALEM TO REPAIR THE FRONT SIDEWALK AT 641 SUPERIOR AVENUE, SALEM, OHIO, IN ACCORDANCE WITH SALEM CITY CODE 901.01, BY MEANS OF APPROPRIATE CONCRETE REPAIR OR REPLACEMENT, ASSESSING COSTS OF SUCH REPAIR TO PROPERTY OWNER ROBERT BIRK, AND DECLARING AN EMERGENCY.
WHEREAS, Salem City Code 901.01 allows the City Council to authorize the repair of any sidewalk in the City; and
WHEREAS, The owner of the property at 642 Superior Avenue has been notified to repair his sidewalk, but has failed to comply; and
WHEREAS, the costs of repairs accomplished by the City may be assessed against the property owner.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SALEM, STATE OF OHIO:
SECTION 1:
The Service Director of the City of Salem be and is hereby authorized to repair the front sidewalk at 641 Superior Avenue, Salem, Ohio, in accordance with Salem City Code 901.01, by means of appropriate concrete repair or replacement, in the event that the property owner does not accomplish such repairs within thirty days of receiving notice of requirement to do so.
SECTION 2:
Written notice requiring such repairs shall be served by the Council Clerk upon the owner or agent of the owner of each parcel of land abutting on the sidewalk in front of 642 Superior Avenue, and the Council Clerk shall return a copy of such notice with the time and manner of service endorsed thereon, signed by the officer serving it, to the Director of Public Service who shall file and preserve it.
SECTION 3:
This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this ordinance or resolution were adopted in an open meeting of this Council and that all deliberations of this Council and of any of its committees that resulted in those formal actions were in meetings open to the public in compliance with the law.
SECTION 4:
That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety in the City of Salem, and shall go into immediate effect for the reason that it is immediately necessary to remedy the hazardous condition of said sidewalk.
