BEING AN ORDINANCE DESIGNATING THE SERVICES THE CITY OF SALEM WILL PROVIDE TO THE TERRITORY PROPOSED FOR THE LEDERLE ANNEXATION, AND DECLARING AN EMERGENCY.
WHEREAS, Section 709.031(B) of the Ohio Revised Code requires an Ordinance or Resolution be adopted by the City of Salem designating the utilities and services upon annexation; and
WHEREAS, a petition for Annexation of Territory to the City of Salem was filed with the Commissioners of Columbiana County, State of Ohio by the property owners in the proposed territory to be annexed, to annex an area of land in Perry Township.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, STATE OF OHIO:
SECTION 1:
That the City will provide adequate police protection and fire protection to the territory proposed by Lederle and the City of Salem for annexation (as indicated in the attached legal description and map) upon annexation.
SECTION 2:
That the City will provide water and sewer service pursuant to existing rules and regulations governing such services.
SECTION 3:
That the City will provide street maintenance, repair, and snow removal upon dedication and acceptance of street located within said territory or which may be constructed within said territory.
SECTION 4:
That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety in the City of Salem and the inhabitants thereof by reason of the immediate need to adopt an ordinance stating the services to be provided to comply with Section 709.031(B) of the Ohio Revised Code, and shall go into immediate effect.
