BEING AN ORDINANCE VACATING A PORTION OF A SIXTEEN FOOT ALLEY, NAMED ALLEY NO. 9, BETWEEN BROADWAY AND ALLEY NO. 6.
WHEREAS, all adjoining property owners have petitioned the City of Salem to vacate a portion of said sixteen foot alley named Alley No. 9, from Broadway to Alley No. 6; and
WHEREAS, it appears that it would be for the best interest of the citizens of the City of Salem to have the said portion of said sixteen foot alley vacated; and
WHEREAS, the Planning Commission of the City of Salem did approve the vacation of the said portion of said sixteen foot alley on March 8, 1999 subject to certain conditions.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, STATE OF OHIO:
SECTION 1:
That the following described portion of a sixteen foot named Alley No. 9, from Broadway to Alley No. 6, be, and the same hereby is vacated:

SECTION 2:
That the alley being vacated shall be subject to any existing or future utility easements.
SECTION 3:
The Law Director is hereby directed to record a copy of the within ordinance in the records of Columbiana County.
SECTION 4:
This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council and that all deliberations of this Council and any of its committees that resulted in those formal actions were in meetings open to the public in compliance with the law.
SECTION 5:
That this Ordinance is hereby to be an emergency measure necessary for the immediate preservation of the public peace, health and safety in the City of Salem, and shall go into immediate effect for the reason that the adjoining owners be allowed to use the vacated alley.
