BEING AN ORDINANCE AUTHORIZING THE SERVICE DIRECTOR TO ADVERTISE AND RECEIVE BIDS FOR SIDEWALK CONSTRUCTION AS A PROJECT INCLUDED IN THE CITY'S FY '97 & FY '98 FORMULA COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAMS, AUTHORIZING THE CITY TO ENTER INTO CONTRACT WITH THE LOWEST AND BEST RESPONSIVE BIDDER, AND DECLARING AN EMERGENCY.
WHEREAS, An activity proposed in the City of Salem FY '97 & FY '98 Formula Community Formula Community Development Block Grant Programs and as included in the Grant Agreements with the State of Ohio is the replacement of sections of sidewalk in the CHIP Target Areas.
WHEREAS, Costs to undertake this activity are provided through the FY '97 and FY '98 Formula CDBG Programs and the FY '98 Community housing Improvement Program.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, STATE OF OHIO:
SECTION 1:
That the Service Director is hereby authorized to advertise and receive bids for a sidewalk construction in conformance with specifications developed for improvements and bidding purposes, and the City through the Board of Control shall enter inter contract with the lowest and best responsive bidder.
SECTION 2:
This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this ordinance or resolution were adopted in an open meeting of this Council and that all deliberations of this Council and of any of its committees that resulted in those formal actions were in meetings open to the public in compliance with the law.
SECTION 3:
That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety in the City of Salem, and shall go into immediate effect for the reason that it is immediately necessary to {text missing}.
