BEING AN ORDINANCE ACCEPTING THE TANNER APPLICATION FOR THE ANNEXATION OF CERTAIN TERRITORY CONTAINING 6.733 ACRES IN PERRY TOWNSHIP TO THE CITY OF SALEM, AND DECLARING AN EMERGENCY.
WHEREAS, a petition for the annexation of certain territory in Perry Township was duly filed by JAMES A. TANNER and
WHEREAS, the petition was duly considered by the Board of County Commissioners of Columbiana County, Ohio, on December, 30, 1998, and
WHEREAS, the Board of County Commissioners has approved the annexation of the territory to the City of Salem as hereinafter described; and
WHEREAS, the Board of County Commissioners certified the transcript of the proceedings in connection with the annexation with the map and petition required in connection therewith to the City Council Clerk who received the same on January 5, 1999, and
WHEREAS, sixty (60) days from the date of the filing have now elapsed in accordance with the provisions of RC 709.04.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, STATE OF OHIO:
SECTION 1:
That the proposed annexation as applied for in the petition of JAMES A. TANNER of the real estate in the territory sought to be annexed and filed with the Board of County Commissioners of Columbiana County, Ohio on September 29, 1998, and which the petition prayed for annexation to the City of Salem, Ohio of certain territory adjacent thereto as hereinafter described, and which the petition was approved for annexation to the City of Salem by the Board of County Commissioners on December 30, 1998, be and the same is hereby accepted. The territory is described in the attached Exhibit A.
The certified transcript of the proceedings for annexation with an accurate map of the territory, together with the petition for its annexation, and other papers relating to the proceedings thereto of the County Commissioners are all on file with the Council Clerk of this City and have been for more than sixty (60) days.
SECTION 2:
That the Clerk be, and hereby is authorized and directed to make three (3) copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto and a certificate as to the correctness thereof. The Clerk shall then forthwith deliver one (1) copy to the County Auditor, one (1) copy to the County Recorder, and one (1) copy to the Secretary of State and shall file notice of this annexation with the Board of Elections within thirty (30) days after it becomes effective, and the Clerk shall do all other things required by law.
SECTION 3:
This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this resolution were adopted in an open meeting of this Council and that all deliberations of this Council and of any of its committees that resulted in those formal actions were in meetings open to the public in compliance with the law.
SECTION 4:
That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety in the City of Salem, and shall go into immediate effect for the reason that it is immediately necessary to accept said application for annexation to promote economic development of the area.
