BEING A RESOLUTION AUTHORIZING WATER AND SEWER TAP-INS , AS INDICATED, TO DAN ADAMSON, AND DECLARING AN EMERGENCY.
WHEREAS the named individual has applied for water and/or sewer tap-in, for his development in Perry Township; and
WHEREAS, the application for water and/or sewer extension and deferred tap-ins was presented to the City prior to amendment by Council of Salem Codified Ordinances 925.07 and 921.10 on April 7, 1998; and
WHEREAS, the Superintendent of Utilities and the Utilities Committee of Council concur in approval of such application for water and sewer tap-ins; and
WHEREAS, the applicant has agreed to properly record a restriction on applicant's deeds stating that the owners, successors, and assigns will at the earliest possible time annex to the City of Salem, and that, should the property owners not agree to be annexed to the City of Salem as allowed by applicable law, the water and sewer service may be disconnected and terminated from the property by the Salem Utilities Department.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, STATE OF OHIO:
SECTION 1:
That water and sewer tap-ins as indicated to the following properties are hereby approved:
Dan Adamson, lots 66, 69, 83 and 86 in Countryside Addition Plats 3 and 4
SECTION 2:
This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this resolution were adopted in an open meeting of this Council and that all deliberations of this Council and of any of its committees that resulted in those formal actions were in meetings open to the public in compliance with the law.
SECTION 3:
That this Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety in the City of Salem, and shall go into immediate effect for the reason that it is immediately necessary to provide water and sewer tap-ins to the projects now under construction.
