BEING A RESOLUTION AUTHORIZING A CITY WATER SERVICE TAP-IN TO THE PROPERTY NOW OWNED BY DONALD J. WUTRICK, GAMBLE ROAD OPPOSITE SALEM EAST COLD RUN RESERVOIR.

The Council of the City of Salem, Columbiana County, Ohio, met in regular session on the 4th day of April, 2000, at the City Hall, Salem, Ohio.

WHEREAS, Gamble Road, Parcel No.'s 06-00476 and 06-00295 is part of a sub-development platted in size to accommodate a septic tank with a public water supply for a domestic water source; and

WHEREAS, the home on either side of Parcel No.'s 06-00476 and 06-00295 now have Salem City Public Water Service; and

WHEREAS, the owner of the Gamble Road, Parcel No.'s 06-00476 and 06-00295 in order to obtain a city water tap-in, will be required to properly record a restriction on the applicant's deed stating that the owner, successors, and assigns will at the earliest possible time annex to the City of Salem, and that, should the property owner not agree to be annexed to the City of Salem as allowed by applicable law, the water service may be disconnected and terminated from the property by the Salem Utilities Department.

NOW, THEREFORE, BE IT RESOLVED by the City of Salem, Ohio that:

(1) The Salem Utilities Department is hereby authorized to grant a water service to Gamble Road Parcel No.'s 06-00476 and 06-00295 upon recording of deed restriction, proper filing of application, service tapping fee payment and approval by the Salem Utilities Department.
