BEING AN ORDINANCE VACATING TWO ALLEYS NAMED ALLEY NO. 8 AND NO. 9 EACH 16 FEET WIDE AND RUNNING WESTERLY APPROXIMATELY 191 FEET FROM S. BROADWAY AVENUE TO THEIR TERMINUS, IN THE CITY OF SALEM, AND DECLARING AN EMERGENCY.
WHEREAS, all adjoining property owners have petitioned the City of Salem to vacate Alley No. 8 and No. 9 each 16 feet wide and running westerly approximately 191 feet from S. Broadway Avenue to their terminus; and
WHEREAS, it appears that it would be for the best interest of the citizens of the City of Salem to have the said Alley No. 8 and No. 9 vacated; and
WHEREAS, the Planning Commission of the City of Salem did approve the vacation of the two alleys on January 10, 2000.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF SALEM, STATE OF OHIO:
SECTION 1:
That the following described Alley No. 8 and No. 9 running westerly from S. Broadway Avenue, be, and the same is hereby vacated:
Situated in the City of Salem, County of Columbiana, and State of Ohio:
And being those two alleys located between Lots #435 and #436, and Lots #437 and #436 as said alleys and said lots are delineated in Samuel Street's First Addition to the City of Salem as shown on the plat thereof as recorded in Plat Book 2, Volume 41, Columbiana County Records. Said alleys being 16 feet in width and extending westerly from South Broadway Avenue in said City, the northernmost alley extending to Lot #595 and the southernmost alley to Lot #596 in said addition.
SECTION 2:
That the alley being vacated shall be subject to any existing or future utility easements.
SECTION 3:
The Law Director is hereby directed to record a copy of the within ordinance in the records of Columbiana County.
SECTION 4:
This Council finds and determines that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council and that all deliberations of this Council and any of its committees that resulted in those formal actions were in meetings open to the public in compliance with the law.
SECTION 5:
That this Ordinance is hereby to be an emergency measure necessary for the immediate preservation of the public peace, health and safety in the City of Salem, and shall go into immediate effect for the reason that the adjoining owners be allowed to use the vacated alley.
