BEING AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF SALEM TO EXECUTE MORTGAGE SUBORDINATION AGREEMENTS AT THE REQUEST OF THE CITY'S COMMUNITY DEVELOPMENT CONSULTANTS, BLECKMAN & ASSOCIATES, IN CONNECTION WITH THE CITY'S HOUSING REHABILITATION AND DOWNPAYMENT ASSISTANCE PROGRAMS.

WHEREAS, the City holds certain mortgages on properties located throughout the City pursuant to the Housing Rehabilitation and Downpayment Assistance Programs funded through the Community Housing Improvement Program as funded through the Ohio Community Development Block Program; and

WHEREAS, the owners of said properties frequently request the City to subordinate or waive priority of its mortgage in favor of another financial lending institution in connection with a new mortgage loan; and

WHEREAS, the new loans will not be approved without the City subordinating its mortgage to that of the new lender; and

WHEREAS, the City's Community Development Consultants, Bleckman & Associates, have requested that Council authorize the Mayor to sign any such subordination agreements which they recommend without the ongoing necessity of passing legislation for each and every such request made.

NOW, THEREFORE, BE IT RESOLVED by the City of Salem, Ohio that:

SECTION 1:

The Mayor is hereby authorized to execute on behalf of the City any mortgage subordination agreement which may be requested from time to time by the City's Community Development Consultant, Bleckman & Associates, in connection with the City's Housing Rehabilitation and Downpayment Assistance Programs.

SECTION 2:

This Ordinance shall take effect and be in full force from and after the earliest time allowed by law.
